These terms are an agreement between you and [Company legal name] (“AI Magicx”, “we”), registered at [registered address], for your use of the AI Magicx website, app and API (the “service”). By creating an account or using the service, you agree to them.
1. Your account
- You must be at least 18, or the age of majority where you live, to use the service.
- Keep your sign-in details safe. You're responsible for activity on your account.
- Give accurate information and keep your email address up to date.
- One person per account. Workspaces may be shared where the service allows it.
2. Plans, mana and payment
- Paid plans renew automatically each month or year until cancelled. You can cancel any time; your plan runs to the end of the paid period.
- Mana is a prepaid unit for paid work (1 mana = US$0.01 of service). Plan mana is granted each month and expires as described on the pricing page. Top-up mana is valid for 12 months. Mana has no cash value, can't be transferred and isn't refundable except as set out in the refund policy.
- Before a paid task starts, we show its estimated price and hold up to the maximum. You are charged for what was actually delivered, never more than the amount held.
- Prices and plan contents may change. We'll give at least 30 days' notice of a price increase to an active subscription.
- API usage is paid from a separate prepaid API balance, at the prices listed in the developer docs.
3. Your content
- You keep ownership of what you put into the service and, as between you and us, of what the service makes for you, subject to the terms of the model providers involved.
- You give us permission to store and process your content only to run the service for you, including sending it to the model providers needed to answer your requests.
- We don't use your content to train models.
- You're responsible for having the rights to the content you upload and for how you use the results.
4. Acceptable use
You agree to follow the acceptable use policy. We may suspend or close accounts that break it.
5. AI output
AI models can be wrong, incomplete or out of date. Check anything important before you rely on it, especially legal, medical, financial or safety matters. Output may be similar to output given to other people.
6. Your own API keys
If you add keys for other providers, requests made with them are also governed by that provider's terms, and that provider bills you directly.
7. Availability and changes
We work to keep the service available but don't guarantee it will be uninterrupted. Models and features may be added, changed or retired, for example when a provider retires a model.
8. Ending the agreement
You can close your account at any time. We may suspend or end access for serious or repeated breaches of these terms, or where required by law. When an account is closed, we delete your content as described in the privacy policy, and keep the financial records the law requires.
9. Liability
To the extent the law allows, the service is provided “as is”, and our total liability for any claim is limited to the amount you paid us in the 12 months before it. Nothing in these terms limits liability that can't be limited by law. [Counsel to confirm wording for consumer jurisdictions.]
